Death Penalty cases in the U.S. have two trials. One to determine guilt or innocence and the second to determine the sentence. In the sentencing trial, the jury weighs aggravating and mitigating evidence. Vernon's court appointed attorney ordered his mitigating investor not to do any investigation. He didn't present any mitigating evidence at Vernon's sentencing trial.
